Guide to Purchasing a Property on the Costa del Sol

Introduction:

At Every Home Marbella we have access to the entire property market on the Costa del Sol with more than 20.000 properties. Therefore you only need us working for you because all estate agents use the same property portal. Even if you see a property on the internet we can contact the owner directly for you and include this property on future tours.

We have been based in Marbella since 2004. Therefore we are extremely knowledgeable of all the areas and properties available on the Costa del Sol. Our main priority is to provide the best service and to develop a great relationship with our clients. We can also recommend suitable Mortgage Brokers to assist with calculating your budget and a Law Firm for once an offer has been accepted.

First: Find with us your property on the Costa del Sol

Now that we know your search criteria we will send you a selection of properties via email. You can then select the ones that most suit your requirements. Once you are ready to begin viewings, simply book your appointment with us and we will arrange a tour of the selected properties. During the tour we will ensure you are fully aware of the fees and taxes associated with this property (an indication is listed in the fourth stage of this buying guide).

Second: Make an offer

Once we have found your dream property you can inform us of your offer. We will then forward it verbal too the vendor on your behalf. At this point there may be a bit of negotiation involved. Once a price has been agreed we can continue.

Third: Reserving the Property

Once we have a verbal or written agreement for the purchase of your property, we have to ensure that the property is reserved and taken off the market. You will be required to sign a reservation document which contains all the terms and conditions of the agreement. At this point a reservation fee would be paid to Every Home Marbella which can vary depending on the property and vendor requirements (normally it’s around 6000 EUR). This is to officially take the property off the market and assure the vendor about the purchase. Finally the reservation form would be signed by the vendor and the property is officially reserved. The reservation fee is non-refundable however it is subject to legal searches. Should there be any irregularities with the search a full refund would be available (as per the terms & conditions of the reservation form).

At this point we would highly recommend you instruct a Law Firm to represent you in the purchase. If you do not have a Law Firm for your property purchase we can recommend one for you.

The Law Firm will carry out all the necessary legal procedures which include but are not limited to the following:

  • – Verify the vendor’s identity and that they are entitled to sell the property.
  • – Checking that the property is legally registered.
  • – Checking that the property is free from charges, debts & mortgages.
  • – Checking that the property has been granted the building permit by the town hall.
  • – Ensuring that the planning and building laws were complied with.
  • – The examination, preparation and eventual signing of contracts.

Once the lawyers have finished their legal checks they will inform you of the results.

An additional and recommended service offered by law firms is the drafting and registration of a Spanish will.

Fourth: Exchange of Contracts

This will depend on the agreement made with the vendor. If it has been agreed to exchange contracts usually a payment of 10% (minus reservation fee already paid) would be paid to the vendor and a contract signed. A mutually agreed completion date will be specified in the contract.

Fifth: Completion

On completion day your lawyer will have prepared everything so that the signing goes as smoothly as possible. Completion can be done in person, however if you cannot be there you can also give your lawyer power of attorney to sign on your behalf for your new property on the Costa del Sol.

Fees & Taxes

It is important to be aware of the purchasing costs in Spain, as these are usually not included in the advertised selling prices. The purchase costs are approximately between 9-12% of the purchase price and the exact amount will depend on additional aspects such as if a mortgage is being obtained.

Approximate Breakdown of Purchasing costs:

Government Transfer Tax (ITP or IVA) between 8% – 10% (Depending on type & price of property).

Legal Fees approximately 1%(may vary depending on law firm and services offered).

Notary & Registry Fees – 1%.

Mortgage Fees (if applicable) between 1 – 2% (may vary from this depending on provider).
